Settlement of a Pharmacy Malpractice

The accident involved the consumption of oxycodone pills in combination with Xanax that led to the untimely demise of CM, a 42-year-old husband and father of five children. CM was a chronic pain patient who was being treated by a pain management doctor on a maintenance dose of Oxycodone. Shortly before his demise CM received it burn on his forearm well doing automobile maintenance that required him to obtain additional pain medications as well as a medicine known as Xanax from doctors other than his pain management doctor.
CM died in his sleep alongside his wife after a long, activity filled day. The medical examiner determined that the cause of death was poly-drug toxicity involving the combination of Oxycodone and Xanax.

CM’s wife contacted Coffey McPharlin because she believed that her husband’s death was preventable. Her husband was having all of his medications filled at the same pharmacy and the medications were being paid for by group health insurance. She believed that the pharmacists at the pharmacy had an obligation to ensure their husband was not receiving a dangerous combination of medicines for overutilizing medications. Sam Coffey filed a lawsuit on behalf of the Estate of CM and was able to negotiate a confidential settlement early on in the litigation process.
